TERMS & CONDITIONS
- Language – For the purposes of this document, the term ‘days’ is interpreted to hold meaning of a specific nature. That is, for the contents below, the term ‘days’ is given the meaning of business days, that is Monday to Friday, excluding officially nominated public holidays or periods.
- Provision and service of food and beverage – Waterfront Venues operates the business and holds the liquor licence. The Client and their guests are not permitted to provide food and beverage without prior arrangement nor consume food or beverage other than those supplied by Waterfront Venues. If Waterfront Venues is unable to provide the agreed menu or services due to unforeseen circumstances (e.g. supplier shortages), Waterfront Venues reserves the right to adapt the menu or services in consultation with the client.
- Availability and pricing – The menu items and prices listed in the menus, whilst current at the time of quotation, are subject to change without further notice.
- Credit card fees – All deposits and payments by credit card attract an additional fee: 2.0% for Mastercard, Visa and American Express. Important note: Waterfront Venues does not accept Diners Club.
- Tentative booking – A booking will be considered tentative pending receipt of a deposit, and will be held without obligation, for a period of seven days from the date of quotation. Once this period has elapsed, Waterfront Venues reserves the right to cancel an unconfirmed booking and, without further notice, re-allocate the space to other enquirers.
- Minimum spends – Each of the space in Waterfront Venues has daily seasonal minimum spend requirement for Food and Beverage. These will be quoted to the client at time of booking prior to receipt of deposit.
- Confirmation of booking – The booking will be considered as confirmed upon receipt of a $2,000 deposit or 25% of the estimated value of the event – whichever is greater – or an amount as otherwise agreed if the event is valued at less than $2,000, together with the completed booking form. Receipt of the deposit and booking form more than seven days after the original booking will be accepted subject to Waterfront Venues confirming availability.
- Expected attendance – The Client represents that the number of expected guests stated on the booking form (“Guest Numbers”) is a realistic expectation of attendance and is the basis upon which the booking is accepted by Waterfront Venues. A minimum number charge is stated on the booking form along with any other minimum requirements.
- Final numbers – Final numbers must be received seven working days before the event. This will constitute the minimum number of guests to be charged for the event and Waterfront Venues will raise an invoice for the agreed services to be paid. Any special dietary requirements should also be advised at this time. Guest numbers can increase up to three working days before the event.
- Payment for agreed services – Payment for the agreed services must be received no later than five working days before the event. Setup will not commence until this payment has been received. Payment can be made via credit card, bank cheque, cash or EFT. Note that Waterfront Venues does not accept personal cheques without prior arrangement.
- Final payment – Any and all charges incurred at the event over and above the agreed services must be paid in full immediately upon the conclusion of the event. To facilitate such payment without delay, a valid credit card and signature on file will be requested before the event.
- Menus and other details – To ensure that the event is successful and runs professionally, menus, timings, entertainment and decorator details are to be confirmed no later than 21 days before the event.
- Event duration – The Client is responsible for occupying and vacating the space within the times scheduled. Use of space outside the times quoted will be subject to availability. Additional charges may apply at the discretion of Waterfront Venues, if the event extends beyond times agreed to in writing.
- After midnight costs – Functions unless otherwise agreed finish at midnight. In the event a client requests a function to continue in a private space beyond this time, minimum hourly food and beverage spends will need to be guaranteed by the client for the periods requested.
- Public holiday surcharge – A surcharge of 20% is applicable for any event held on a declared public holiday. For events extending into a public holiday, a surcharge may be applicable pending the level of service required.
- Furniture – Waterfront Venues has a range of furniture in house. In the event furniture other than that of the venue is required or requested this will incur an additional charge.
- Entertainment – Waterfront Venues is able to assist with all entertainment requirements. Performers must be current members of their respective unions. In the event of entertainment being played in BCM Bar and the Waterfront Room, Waterfront Venues cannot guarantee that sound will not be heard in either room. Where possible, timings and speeches will be coordinated so as not to cause disruption to the event. All sound equipment must be fitted with acoustic limiters to comply with Waterfront Venue’s DA provisions and the N2 standards for the area. Waterfront Venues retains sole right and discretion to set volume for and during an event.
- Security – Waterfront Venues provides security at its entrances on Friday and Saturday nights. Additional security can be hired at a charge of $50.00 per hour. Waterfront Venues reserves the right to exclude persons without liability from entering the premises. Security costs must be paid in full no later than seven days before the event.
- Ticketed events – Promoters who ticket events at Waterfront Venues are required to pay a $2000 refundable bond and agree to the security costs under Waterfront Venues DA and licensing requirements. Bond costs must be paid in full no later than seven days before the event.
- Indemnity – The Client shall at all times indemnify Waterfront Venues, its directors and employees, in respect of any liability, claim or proceeding arising in respect of personal injury to or the death of any person or arising in respect of any loss, damage or loss of use of property in any way relating to the event or relating to persons attending the event except to the extent of contribution of any negligent act or omission by Waterfront Venues.
- Event cancellation – In the regrettable situation that the Client cancels the event, written notification is required and the following cancellation fees will apply:
– 60 days or more prior to the event – 50% of the deposit will be retained by Waterfront Venues
– More than 30 days but less than 60 days – 100% of the deposit will be retained by Waterfront Venues
– More than 7 days but less than 30 days – 50% of the guaranteed minimum charges to be paid to
Waterfront Venues
– Less than 7 days – Full minimum charges (100%) to be paid to Waterfront Venues.
